1. This Competition is open to all residents of the United Kingdom, the Isle of Man, the Channel Islands and the Republic of Ireland,  (Under 18s will need written consent from a parent or guardian).  Employees (or family members of employees) of any British Sky Broadcasting Group company, companies associated with the Competition and all affiliates of such companies (collectively "Sky") may not enter the Competition.

2.HOW TO ENTER

2.1 To enter the Competition you need to comply with following steps:

2.1.1 Develop an original standalone application, using Sky News RRS feeds  (provided by us) of headlines, or pictures, or video (or a combination), which carries Sky News beyond its home environment (www.sky.com/news ) .  The application should run in 3rd party environments, including websites and/or desktops (the "Contribution").

2.1.2 Entrants must credit any open source code used in their applications.
e.g when using open source code like the standard flash detection software  http://news.sky.com/skynews/js/swfobject.js

2.1.3 Submit your Contribution together with your name, address and telephone number to newsonline@bskyb.com, with "Development Garage" in the subject field before Thursday 31st January 2008 (the "Closing Date") (extended on Tuesday 11th Dec).  Sky will not accept any entries received after the Closing Date, and does not accept responsibility for network, computer hardware or software failures of any kind, which may restrict or delay the receipt of your email.

2.1.4 Sky will select approximately 10 Contributions whose applications show the most potential, from the points of view of design, usability, innovation and originality, to be deployed into a live environment, and could most successfully distribute Sky News content via new methods, web or otherwise.  Those selected Contributions will enter a final (the "Final").  Sky reserves the right to select more or less than 10 Contributions depending on the standard of Contributions.  Sky will contact those entrants who submitted the successful Contributions (the "Finalists") by Friday 8th February 2008 (extended Tuesday 11th Dec).

2.1.5 The Finalists must make themselves available to travel to Sky's head office in Osterley, Middlesex on Thursday 21st February 2008 (extended Tues 11th Dec) for the Final, to pitch their idea to a panel of judges (the "Panel").  The identity and areas of expertise of the Panel will be supplied to the Thursday 21st February 2008.  Sky will not pay the Finalists' travel expenses.

2.1.6 If any Finalist is not able, for whatever reason, to travel to Sky's head office, then Sky reserves the right to select another Finalist.

2.1.7 The Panel will ask each Finalist to demonstrate his application running on live data, either on his own webspace or on a desktop (as appropriate), and to give a 5-minute presentation explaining to the panel its functionality and the reasons why Sky should deploy it (the "Pitch").  The Panel will judge the Finalists on originality, the delivery of their pitch, innovation, usability and design, and select 1 winner of the Competition (the "Winner") and 5 runners-up (the "Runners-Up") on the basis of the Pitches made to them by the finalists. The Winner and Runners-Up will, in the opinion of the Panel, have created the applications which make best use of Sky News content in the feeds provided, and which can deployed to most effectively distribute Sky News content via new methods, web or otherwise.  Particular consideration will be given to the end-user experience, design, and usability.  The Panel reserves the right to select additional Runners-Up depending on the standard of the Finalists' Pitches.

2.2 Entries must not be sent in through agents or third parties.

2.3 A person may only enter the Competition once.

3. RIGHTS TO FINALIST'S CONTRIBUTION

3.1 Sky will keep details of, and retain a licence to use the Contribution of each Finalist, whether or not that Finalist is selected to be the Winner or a Runner-Up.  Sky will require each Finalist, and, if a Finalist is under 18, a parent or guardian, to sign a separate agreement confirming Sky's rights to use the Contribution.

3.2 All Finalists agree that the copyright (if any) and all other rights, title and interest, in and in respect of their Contribution, will be licensed by the Finalist to Sky as follows:
(a) Sky shall have an exclusive royalty free worldwide license in all media in the Finalist's Contribution for a period of 3 months from the date of the submission of the Contribution by the Finalist;
(b) after that 3 month period, Sky shall have a non-exclusive royalty free worldwide license in perpetuity in all media in the Finalist's Contribution.
All Finalists must agree that no payment (other than Prizes where awarded) shall be due to them nor shall they make a claim for any further payment against Sky or its licensees or assigns in respect of the license of such rights.

3.3 All Finalists hereby waive any so-called "moral rights of authors" in the Contribution and such rights under section 77 and section 80 of the Copyright Designs and Patents Act 1988 (the"Act") as they may now have or hereafter acquire in relation to the Contribution and all Finalists hereby grant Sky consent under Part II of the Act to enable Sky to make the fullest possible use of their Contribution hereunder.

3.4 All Finalists hereby undertake that their Contribution shall not contain anything which is untrue, or an infringement of a third-party's copyright or may give rise to any claim or which is calculated to bring Sky into disrepute, or which is defamatory, blasphemous or obscene.

3.5 All Finalists hereby undertake that their Contribution shall not include, knowingly or otherwise, any malicious functionality, code, spyware, or adware which could harm Sky's or any 3rd party's systems.

4. THE PRIZE

4.1 The Winner's and Runners'-Up  prizes will take the form of cash.  The prize for the Winner shall not be less than £1000.  The prize for each Runner-Up shall not be less than £200.  Sky reserves the right to increase the value of the prizes awarded, depending on the quality of the Winner's and Runner's-Up Pitches and Contributions.

4.2 Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, Sky and its associated companies and agents exclude responsibility and all liabilities arising from any postponement, cancellation, delay or changes to the prize details beyond Sky's control.

4.3 If any Winner is not able, for whatever reason, to accept a prize, then Sky reserves the right to award the prize to a Runner-Up.

4.4 Sky's decision is final and legally binding on all entrants.  No correspondence will be entered into.  Entries that do not comply in full with these entry rules and conditions will be disqualified.

5. NOTIFICATION OF WINNER AND RUNNERS-UP

5.1 The Winner and Runners-Up in the Competition will be notified in person on Thursday 21st February 2008 (extended Tues 11th Dec).

5.2 Details of the names and counties of residence of the Winner and the Runners-Up of the Competition will be available for one month after the Close of the Competition by writing to Sky at the address set out above and stating the name and date of the Competition.

5.3 The name, county of residence of the Winner and the Runners-Up of the Competition may be used by Sky and its associated companies for post-event publicity purposes.
